HSN 2916 12 10 (butyl acrylate) is covered by a Bureau of Indian Standards Quality Control Order. - 1Source only from a Bureau of Indian Standards CM/L-licensed manufacturer holding a current licence against IS 14709:1999 for n-butyl acrylate. Verify the supplier's CM/L number, licensed product scope, and licensed manufacturing facility on the BIS online register before placing the purchase order.n-Butyl Acrylate (Quality Control) Amendment Order, 2023 · S.O. 5438(E) dated 24-12-2021 as amended by S.O. 2729(E) dated 20-06-2023
- 2Ensure every consignment lot bears the ISI mark and the supplier's CM/L number under Scheme-I of Schedule-II to the BIS (Conformity Assessment) Regulations, 2018. Marking must be on the product container or label, not on outer packaging alone.Scheme-I of Schedule-II to the BIS (Conformity Assessment) Regulations, 2018 · S.O. 5438(E) dated 24-12-2021
- 3Include mandatory additional qualifiers in the import declaration for Chapter 29 commodities as prescribed in paragraphs 4.1 and 4.2 of CBIC Circular 23/2023-CUS. Non-compliance with the qualifier requirement has applied from 15 October 2023.CBIC Circular 23/2023-CUS dated 30-09-2023
- 4Confirm whether the imported n-butyl acrylate formulation falls within the Schedule to the Insecticides Act, 1968. If so, registration and a permit from the Secretariat of the Central Insecticides Board and Registration Committee are required, and import is restricted to specified places under Rule 45 of the Insecticides Rules, 1971.Insecticides Act, 1968 · Rule 45 of the Insecticides Rules, 1971 · ITC (HS) policy condition for Chapter 29
- 5Quote the supplier's BIS CM/L number on the bill of entry alongside the mandatory Chapter 29 qualifiers. Customs verifies the CM/L in real time against the BIS register; an absent, expired, or scope-mismatched CM/L triggers consignment detention.n-Butyl Acrylate (Quality Control) Amendment Order, 2023 · BIS Act, 2016 · Customs Act, 1962
The most common error on this tariff line is relying on the original S.O. 5438(E) notification date of 24 December 2021 as the enforcement date, when the operative date for mandatory ISI marking is 22 December 2023 as stated in the CCR under the amendment order. Consignments shipped before that date under the earlier notification but cleared after 22 December 2023 without a valid CM/L-backed ISI mark face detention and potential rejection at port — the amendment date, not the original gazette date, is the control point for customs verification.
