Import of parts of gas-fuelled pocket lighters is additionally Restricted under Directorate General of Foreign Trade policy, applying as a separate customs-clearance overlay.
Procedural directions for customs clearance are issued by: Directorate General of Foreign Trade.
- 1Source only from a Bureau of Indian Standards CM/L-licensed manufacturer holding a current licence against IS/ISO 9994:2018 (lighter safety) or IS/ISO 22702:2018 (utility lighter safety) as applicable. Verify the CM/L number, licensed product scope, and manufacturing facility on the BIS online register before placing the purchase order.Flame-Producing Lighters (Quality Control) Amendment Order, 2024 · S.O. 2986(E) dated 05-07-2023 · S.O. 4230(E) dated 20-09-2024
- 2Ensure each part bears the ISI Standard Mark and the supplier's CM/L number per Scheme-I of Schedule-II of the BIS (Conformity Assessment) Regulations, 2018. Marking must appear on the product or its smallest unit of packaging traceable to the licensed batch.Scheme-I of Schedule-II of the Bureau of Indian Standards (Conformity Assessment) Regulations, 2018 · Flame-Producing Lighters (Quality Control) Amendment Order, 2024
- 3Obtain a valid import licence or meet the Restricted-category policy condition before shipping. Import of parts of gas-fuelled, non-refillable or refillable pocket lighters is Restricted under ITC(HS) import policy; DGFT Notification 36/2024-25 governs the applicable conditions.DGFT Notification 36/2024-25 dated 13-10-2024
- 4If the importing enterprise is registered on the Udyam Portal as a Micro Enterprise (investment ≤ ₹1 crore, turnover ≤ ₹5 crore in the previous financial year as certified by a Chartered Accountant), the QCO obligation is inapplicable. Small Enterprises were covered from 06-04-2024; Micro Enterprises from 06-07-2024.Flame-Producing Lighters (Quality Control) Amendment Order, 2024 · S.O. 2986(E) dated 05-07-2023 · Micro, Small and Medium Enterprises Development Act, 2006 (27 of 2006)
- 5Quote the supplier's BIS CM/L number and the DGFT import authorisation on the bill of entry. Customs verifies the CM/L in real time; an absent, expired, or scope-mismatched CM/L — or failure to satisfy the Restricted-category policy condition — triggers consignment detention.Flame-Producing Lighters (Quality Control) Amendment Order, 2024 · BIS Act, 2016 · Customs Act, 1962 · DGFT Notification 36/2024-25 dated 13-10-2024
The most common error on this tariff line is importing parts under the assumption that only finished lighters are within QCO scope — the Flame-Producing Lighters (Quality Control) Amendment Order, 2024 captures parts of flame-producing lighters, and the DGFT Restricted policy condition independently blocks entry of gas-fuelled pocket lighter parts without prior authorisation. An importer who clears the BIS CM/L hurdle but has not addressed the Restricted-category condition faces detention on the DGFT policy ground alone, with demurrage and ground rent accruing while the authorisation is sought retrospectively.
