Compliance steps
  1. 1
Source only from a Bureau of Indian Standards CM/L-licensed manufacturer holding a current licence against IS 9873 (Parts 1, 2, 3, 4, 7, and 9) and IS 15644. Verify the supplier's CM/L number, licensed product scope, and facility address on the BIS online register before placing the purchase order.
    Toys (Quality Control) Order, 2020 · S.O. 853(E) dated 25-02-2020 · S.O. 3146(E) dated 15-09-2020 · S.O. 4514(E) dated 11-12-2020
  2. 2
Ensure the imported parts and accessories bear the ISI Standard Mark and the supplier's CM/L number. Marking must appear on the product itself; marking only on packaging does not satisfy the Toys QCO requirement.
    Toys (Quality Control) Order, 2020 · S.O. 853(E) dated 25-02-2020 · BIS (Conformity Assessment) Regulations, 2018 Scheme-I
  3. 3
Obtain and retain the certificates of conformity to IS 9873 (Parts 1, 2, 3, 4, 7, and 9) and IS 15644:2006 as required under Policy Condition 2 of Chapter 95. Customs is empowered to draw random samples and send them to NABL-accredited laboratories; the consignment may be conditionally released but goods cannot enter commerce until the sample passes.
Policy Condition 2 of Chapter 95 · DGFT Notification 33/2015-20 dated 02-12-2019 · Para 2(D) of General Notes to ITC(HS)
  4. 4
Quote the supplier's BIS CM/L number on the bill of entry and follow the licence-verification flowchart in CBIC Instructions 06/2023-Cus. Customs verifies the CM/L in real time; an absent, expired, or scope-mismatched licence triggers consignment detention.
    CBIC Instructions 06/2023-CUS dated 13-02-2023 Paragraphs 1 to 6
  5. 5
If the consignment includes any drone or UAV component, separately verify whether it attracts the drone import prohibition under DGFT Notification 54/2015-20. Drone components are free to import but CBU, SKD, and CKD drones require an Import Authorisation from the Directorate General of Foreign Trade.
    DGFT Notification 54/2015-20 dated 09-02-2022 · DGFT Notification 30/2015-20 dated 08-11-2019 · Policy Condition 3 of Chapter 95
A word of counsel

The single most common error on this tariff line is treating parts and accessories of electronic toys as falling outside the Toys (Quality Control) Order because they are not finished toys — the QCO and Policy Condition 2 of Chapter 95 expressly apply to parts and accessories, and customs draws random samples from every consignment for NABL laboratory testing. A conditional release at port does not permit market sale; goods that fail the sample test face destruction or re-export at the importer's cost, with no remedy once the consignment is inside the country.

Frequently asked
Does HSN 9503 00 91 require BIS certification?
Yes. Parts and accessories of electronic toys must conform to IS 9873 (Parts 1, 2, 3, 4, 7, and 9) and IS 15644 under the ISI Mark Scheme, mandatory under the Toys (Quality Control) Order, 2020 from 25 February 2020; import is permitted only from manufacturers holding a current BIS CM/L licence.
Can goods be sold in the market after a conditional customs release pending NABL sample testing?
No. Under Policy Condition 2 of Chapter 95, conditional release allows the consignment to be held but not sold until the random sample clears NABL-accredited laboratory testing; a failed test result leads to re-export or destruction at the importer's cost.
Does the BIS QCO apply only to finished electronic toys or also to their parts?
The Toys (Quality Control) Order, 2020 and Policy Condition 2 of Chapter 95 apply to toys and parts of toys; Para 2(D) of the General Notes to the ITC(HS) confirms that toys and similar recreational goods under any chapter are governed by BIS standards as specified.
Does a single CM/L licence cover all parts and specifications from the same manufacturer?
No. A CM/L licence is scope-specific by IS standard, product description, and manufacturing facility; parts outside the licensed scope or from an unlicensed plant are not covered and customs detains the consignment on a scope mismatch.
