Compliance steps
  1. 1
Source only from a Bureau of Indian Standards CM/L-licensed manufacturer holding a current licence against IS 9873 (Parts 1, 2, 3, 4, 7 and 9) and IS 15644:2006. Verify the supplier's CM/L number, licensed product scope, and manufacturing facility on the BIS online register before placing the purchase order.

  2. 2
Ensure each toy bears the ISI mark and the supplier's CM/L number per Scheme-I of Schedule-II to the BIS (Conformity Assessment) Regulations, 2018. The standard mark must appear on the product itself and be traceable to the licensed facility.

  3. 3
Accompany each consignment with certificates of conformity to IS 9873 (Parts 1, 2, 3, 4, 7 and 9) and IS 15644:2006. Customs will draw random samples for testing by NABL-accredited laboratories; clearance on condition that the product cannot be sold until successful test results are received.
Policy Condition 2 of Chapter 95 · DGFT Notification 33/2015-20 dated 02-12-2019 · Para 2(D) of General Notes of ITC(HS)
  4. 4
Quote the supplier's BIS CM/L number on the bill of entry and retain conformity certificates. Consult the BIS website access procedure described in CBIC Instructions 06/2023-CUS for verifying licence status; absent, expired, or scope-mismatched CM/L triggers detention and the consignment may be sent back or destroyed at importer's cost.
CBIC Instructions 06/2023-CUS dated 13-02-2023 · Toys (Quality Control) Order, 2020 · BIS Act, 2016
  5. 5
Obtain Extended Producer Responsibility authorisation from the Central Pollution Control Board before importing electrical trains, car racing sets, or sports equipment with electrical or electronic components. MSMED Act-registered micro enterprises are exempt. Quote the EPR authorisation on the bill of entry.

A word of counsel

The single most common error on this tariff line is presenting conformity certificates only to IS 9873 while omitting IS 15644:2006 — customs policy requires compliance with both standards simultaneously, and a certificate covering only the IS 9873 parts is insufficient for clearance. A sample will be drawn from every consignment regardless of certificate quality; goods that fail NABL testing are returned or destroyed at the importer's expense with no recourse, making pre-shipment third-party verification against both standards at an NABL-accredited laboratory the decisive risk-control measure.

Frequently asked
Does HSN 9503 00 10 require BIS certification?
Yes. Electronic toys under this tariff line must conform to IS 9873 (Parts 1, 2, 3, 4, 7 and 9) and IS 15644:2006 under the ISI Mark Scheme, operative under the Toys (Quality Control) Order, 2020. Import is permitted only from manufacturers holding a current BIS CM/L licence.
Is Extended Producer Responsibility authorisation required separately from BIS QCO compliance?
Yes, for electrical trains, car racing sets, and sports equipment with electrical or electronic components. EPR authorisation is administered independently under Schedule-I of the E-Waste (Management) Rules, 2022; micro enterprises registered under the MSMED Act, 2006 are exempt.
What happens if the NABL sample test fails after conditional customs clearance?
The consignment is sent back or destroyed at the importer's cost. Goods may not be sold in the market pending successful test results, and a failed test result triggers mandatory re-export or destruction under the Toys (Quality Control) Order, 2020.
Does one CM/L licence cover all parts and variants of electronic toys from the same manufacturer?
No. The CM/L is scope-specific by IS standard part, product variant, and licensed manufacturing facility; toys outside the licensed specification or from an unlicensed plant are not covered and will be detained at customs.
