Liquid level gauges for flow and level measurement
HSN 9026 10 20 (Level gauges) is subject to Central Drugs Standard Control Organisation (CDSCO) registration under the Medical Devices Rules, 2017, where the device is listed in G.S.R. 102(E) dated 11-02-2020 issued by the Ministry of Health and Family Welfare (MOHFW). Legal Metrology Act, 2009 verification of registration and product-approval certificates applies additionally where the device functions as a volumetric container-type liquid measuring instrument.

The principal error on this tariff line is failing to determine — before shipment — whether the specific level gauge model is captured by G.S.R. 102(E). The CDSCO registration obligation is product-specific, not category-wide: a non-medical industrial level gauge clears without CDSCO registration, while an identical-looking device used in a medical application requires registration, and import without it results in consignment detention and possible confiscation under the Drugs and Cosmetics Act, 1940. Scope classification should be resolved at purchase-order stage, not at the port of entry.
