- 2Check whether the instrument also falls within the list of telecom products notified under the MTCTE scheme. If listed, obtain mandatory MTCTE type-approval certification from the Department of Telecommunications before import, in compliance with Indian Telegraph (Amendment) Rules, 2017 and DoT Notification F.No.5-2/2024-TC/TEC(Pt.1) dated 25-02-2025.Indian Telegraph (Amendment) Rules, 2017 · DoT Notification TEC/01/2017-TC dated 04-07-2019 as amended by F.No.5-2/2021-TC/TEC/131 dated 13-06-2022 and F.No.5-2/2024-TC/TEC(Pt.1) dated 25-02-2025
The critical error on this residual tariff line is assuming that 9025 80 90 is a generic instrument HSN with no PGA obligations. The CDSCO trigger is product-specific: if the instrument measures a physiological parameter and meets the G.S.R. 102(E) device definition, CDSCO registration is mandatory regardless of whether the importer regards it as an industrial instrument. Misclassifying a listed medical measuring instrument as a general-purpose instrument to avoid CDSCO registration constitutes an import in contravention of the Medical Devices Rules, 2017 and attracts seizure and monetary penalty.
