Other drawing and mathematical calculating instruments (medical device)
HSN 9017 20 90 (Other drawing, marking-out or mathematical calculating instruments) is subject to Central Drugs Standard Control Organisation (CDSCO) registration under the Medical Devices Rules, 2017, where the product is a medical device listed in G.S.R. 102(E) dated 11-02-2020 issued by the Ministry of Health and Family Welfare (MOHFW). Imports of listed devices must comply with all registration and licensing conditions prescribed in that notification before a bill of entry can be presented for out-of-charge.
- Import Registration from CDSCO
- MOHFW notification compliance declaration
- Manufacturing licence from CDSCO
- 1Determine whether the specific instrument falls within the medical devices listed in G.S.R. 102(E) dated 11-02-2020. If listed, obtain the requisite CDSCO import registration or licence before filing the bill of entry; non-listed instruments under this HSN are not subject to this regime.G.S.R. 102(E) dated 11-02-2020, Ministry of Health and Family Welfare
- 2Comply with all conditions of registration prescribed in G.S.R. 102(E) dated 11-02-2020, including any foreign-manufacturer registration requirements under CDSCO. Upload mandatory CDSCO registration documentation in e-Sanchit prior to out-of-charge at the customs station.G.S.R. 102(E) dated 11-02-2020; Medical Devices Rules, 2017
The most common error on this tariff line is assuming that because the HSN descriptor reads as a general drawing or calculating instrument, CDSCO controls do not apply. The critical trigger is product function, not tariff heading: if the instrument is intended for a medical purpose and falls within G.S.R. 102(E) dated 11-02-2020, CDSCO registration is mandatory regardless of the broad HSN scope. Consignments cleared without the required CDSCO registration are liable to detention and confiscation under the Drugs and Cosmetics Act, 1940.
