Petrol-engine passenger cars, 1500cc to 2500cc cylinder capacity
HSN 8703 32 99 (petrol-engine passenger cars exceeding 1,500 cc but not exceeding 2,500 cc) is subject to the Directorate General of Foreign Trade (DGFT) import policy conditions under Chapter 87 of the ITC (HS) Schedule. New vehicles are governed by Policy Conditions 2, 7, and 9; used or second-hand vehicles by Policy Condition 1; and customised cars by Policy Condition 10. Exemption carve-outs under Policy Conditions 3, 4, 5, 6, and 11 apply to specified categories such as personal use, demonstration, testing, and research imports.

The most common error on this tariff line is conflating the policy-condition track for new vehicles with that for used or second-hand vehicles: the two regimes are distinct, and filing a bill of entry for a second-hand vehicle against the new-vehicle policy conditions — or vice versa — results in consignment detention and potential confiscation. Vintage motor vehicle imports by actual users were made free by DGFT Notification 58/2024-25 amending Condition 1(iii); an importer relying on an older reading of Policy Condition 1 without incorporating this amendment risks an erroneous Restricted classification at the bill-of-entry stage.
