HSN 8703 23 92 covers specialised transport vehicles such as ambulances and prison vans with engine displacement exceeding 1,500 cc but not exceeding 3,000 cc, and is subject to the ITC (HS) import policy administered by the Directorate General of Foreign Trade (DGFT) under Policy Conditions 2, 7 and 9 of Chapter 87 for new vehicles, and Policy Condition 1 for second-hand or used vehicles. The most common error on this tariff line is applying the new-vehicle policy conditions (2, 7 and 9) to a used or second-hand specialised vehicle, or vice versa — the two regimes are mutually exclusive and attract different documentation and homologation requirements. Importers of ambulances acquired from foreign fleet disposals must ensure the consignment is correctly declared as second-hand under Policy Condition 1, since misclassification as new attracts Restricted-import enforcement and potential confiscation at the port of entry.
