HSN 8702 40 11 (Integrated monocoque vehicle, air-conditioned) is subject to the ITC (HS) import policy administered by the Directorate General of Foreign Trade (DGFT), with new vehicles governed by Policy Conditions 2, 7 and 9 of Chapter 87 and used vehicles by Policy Condition 1. The most common error on this tariff line is applying the new-vehicle policy conditions to a used or refurbished electric bus, or vice versa. New and second-hand vehicles are governed by separate and mutually exclusive policy condition sets — Conditions 2, 7 and 9 for new vehicles versus Condition 1 for used — and misclassification of the vehicle's condition at the bill-of-entry stage results in consignment detention and DGFT-policy enforcement, with potential re-export orders where the incorrect policy track was invoked.
