HSN 8539 32 10 (Mercury vapour lamps) is subject to Central Pollution Control Board (CPCB) Extended Producer Responsibility (EPR) authorisation under Schedule I of the E-Waste (Management) Rules, 2022 notified vide G.S.R. 801(E) dated 02-11-2022. The EPR authorisation must be in place at the bill-of-entry stage for importers of fluorescent and other mercury-containing lamps. Micro-enterprises as defined under the MSME Development Act, 2006 are exempt from the EPR requirement.

The most common error on this tariff line is importing mercury vapour lamps without an active CPCB EPR authorisation on the assumption that the obligation is post-import and operational only.
