HSN 8525 50 90 (Other transmission apparatus) carries mandatory Extended Producer Responsibility (EPR) authorisation from the Central Pollution Control Board (CPCB) under Schedule I of the E-Waste (Management) Rules, 2022, notified via G.S.R. 801(E) dated 02-11-2022. The tariff line is also Restricted under the ITC (HS) import policy administered by the Directorate General of Foreign Trade (DGFT), and telecom-product compliance under the Mandatory Testing and Certification of Telecom Equipment (MTCTE) framework applies where the product falls within DoT-notified categories.
- EPR authorisation from CPCB
- Import Licence from DGFT
- MTCTE certificate from DoT
Procedural directions for customs clearance are issued by: Directorate General of Foreign Trade, Central Board of Indirect Taxes and Customs.
- 1Obtain CPCB Extended Producer Responsibility authorisation before filing the bill of entry. EPR authorisation is mandatory for importers of radio-broadcasting or television transmission apparatus listed under Schedule I of the E-Waste (Management) Rules, 2022; the exemption for micro-enterprises as defined under the MSME Development Act, 2006 should be confirmed in writing before relying on it.Schedule I of the E-Waste (Management) Rules, 2022 · G.S.R. 801(E) dated 02-11-2022
- 2Verify whether the specific product falls within the list of telecom products notified under MTCTE for mandatory certification, as amended by DoT Notification F.No.5-2/2024-TC/TEC(Pt.1) dated 25-02-2025. If so, the MTCTE certificate from the Department of Telecommunications must be obtained and uploaded in e-Sanchit prior to out-of-charge.Indian Telegraph (Amendment) Rules, 2017 · DoT Notification TEC/01/2017-TC dated 04-07-2019 as amended by F.No.5-2/2021-TC/TEC/131 dated 13-06-2022 and F.No.5-2/2024-TC/TEC(Pt.1) dated 25-02-2025
- 3Confirm ITC (HS) Restricted-import status with DGFT and secure the applicable import licence before shipment. Note that Low Noise Block (LNB) down converters are classifiable under HSN 8543 70 99 and not under this tariff line; misclassification will trigger re-assessment and detention.ITC (HS) Import Policy, Restricted category · CBIC Circular 13/2013-Cus dated 05-04-2013
The most common error on this tariff line is overlooking the EPR authorisation requirement on the assumption that it applies only to end-consumer electronics — Schedule I of the E-Waste (Management) Rules, 2022 explicitly covers transmission apparatus, and arrival without a current CPCB EPR authorisation exposes the consignment to detention and the importer to monetary penalty under the Environment (Protection) Act, 1986. The micro-enterprise exemption from EPR does not extend to the MTCTE certification obligation, which is product-category-specific and must be assessed separately.
