The single most common error on this tariff line is treating the staggered enforcement schedule as an indefinite grace period. The enterprise-size classification — general, small, or micro — must be determined against the importer's own MSMED Act registration status, not the foreign supplier's. An importer who has crossed the general-enterprise threshold but declares small- or micro-enterprise status to defer compliance faces detention and potential penalty; the burden of proof on enterprise classification lies with the importer at the time of each bill of entry.
