Torch
Portable electric torches and flashlights (battery-operated)
HSN 8513 10 10 (portable electric torches) is covered by a Bureau of Indian Standards Quality Control Order. Conformity to IS 2083 is mandatory under the ISI Mark Scheme by virtue of the Flashlight (Quality Control) Order, 2025 notified as S.O. 501(E) dated 21 January 2025, with staggered enforcement dates by enterprise category. No separate customs-clearance overlay applies beyond the BIS QCO.
- 1Source only from a Bureau of Indian Standards CM/L-licensed manufacturer holding a current licence against IS 2083. Verify the supplier's CM/L number, licensed product scope, and manufacturing facility address on the BIS online register before placing the purchase order.Flashlight (Quality Control) Order, 2025 · S.O. 501(E) dated 21-01-2025 · Scheme-I of Schedule-II to the BIS (Conformity Assessment) Regulations, 2018
- 2Confirm that the applicable enforcement date has passed for the supplier's enterprise category: 28 July 2025 for general enterprises, 28 October 2025 for small enterprises, and 28 January 2026 for micro enterprises as defined under the Micro, Small and Medium Enterprises Development Act, 2006.S.O. 501(E) dated 21-01-2025 · Flashlight (Quality Control) Order, 2025
- 3Ensure every torch bears the ISI mark and the supplier's CM/L number per Scheme-I of Schedule-II to the BIS (Conformity Assessment) Regulations, 2018. Marking must appear on the product itself, not on packaging alone.Scheme-I of Schedule-II to the BIS (Conformity Assessment) Regulations, 2018 · Flashlight (Quality Control) Order, 2025
- 4Quote the supplier's BIS CM/L number on the bill of entry. Customs verifies the CM/L in real time against the BIS register; an absent, expired, or scope-mismatched licence triggers consignment detention.Flashlight (Quality Control) Order, 2025 · S.O. 501(E) dated 21-01-2025 · BIS Act, 2016 · Customs Act, 1962
- 5If claiming an exemption, retain and produce documentation establishing the exemption basis per paragraph 2 of S.O. 501(E). The exemption grounds must be documented before the consignment arrives at port.S.O. 501(E) dated 21-01-2025 · Flashlight (Quality Control) Order, 2025 para 2
The single most common error on this tariff line is overlooking the staggered enforcement calendar: the general enterprise deadline of 28 July 2025 has passed, but importers sourcing from micro or small enterprises abroad often assume the later dates apply to the importer rather than to the manufacturer's enterprise classification. The enterprise-category determination under the Micro, Small and Medium Enterprises Development Act, 2006 attaches to the foreign manufacturer, not the Indian importer; an Indian importer of any size sourcing from a general-category foreign manufacturer must comply from 28 July 2025 regardless of the importer's own MSME status.
