Of an output exceeding 5,000 kVA but not exceeding 10,000 kVA
Diesel generating sets exceeding 5,000 kVA up to 10,000 kVA
HSN 8502 13 50 (diesel generating sets of 5,000–10,000 kVA output) is subject to Bureau of Energy Efficiency (BEE) appliance labelling and compliance requirements under the Bureau of Energy Efficiency (Appliance Labeling and Compliance) Regulations, 2026, and to Central Pollution Control Board (CPCB) Type Approval with emission and noise norm conformance under the Environment Protection Rules, 1986. Import of second-hand diesel generating sets is Restricted under Para 2.31 of the Foreign Trade Policy, administered by the Central Board of Indirect Taxes and Customs (CBIC).
- Type Approval certificate from CPCB
- Certificate of Conformity of Production from CPCB
- Conformance label from BEE
Procedural directions for customs clearance are issued by: Central Board of Indirect Taxes and Customs.
- 1Obtain CPCB Type Approval and a Certificate of Conformity of Production confirming compliance with emission and noise norms applicable to diesel/petrol/kerosene/LPG/NG generating sets. Verify that the DG set meets the standards referenced under Sr. No. 88, 94, 95, 95A, 95B and 95C of Schedule I of the Environment Protection Rules, 1986, as amended, and that conformance labelling is affixed before importation.Environment Protection Rules, 1986, Schedule I, Sr. No. 88, 94, 95, 95A, 95B and 95C; CBIC Letter F.No.401/67/2022-Cus III dated 26-05-2023; CPCB Letter No. CP-29/10/2022-UPC-I-HO-CPCB-HO-927 dated 26-05-2023; G.S.R. 804(E) dated 03-11-2022
- 2Ensure the generating set carries the BEE appliance label as required under the Bureau of Energy Efficiency (Appliance Labeling and Compliance) Regulations, 2026. Upload the conformance documentation at the bill of entry in e-Sanchit before out-of-charge.BEE Notification No. 5506/BEE/S&L/AL/2025-26 dated 26-12-2025
- 3If the consignment is second-hand, note that import of second-hand diesel generating sets is Restricted under Para 2.31 of the Foreign Trade Policy. A specific import licence or permitted-basis clearance from DGFT must be secured before filing the bill of entry; arrival without prior authorisation exposes the consignment to detention and re-export.Para 2.31 of the Foreign Trade Policy; General Note 2 to the Import Policy
The most common error on this tariff line is presenting CPCB emission-compliance documentation without the BEE appliance labelling credential — or vice versa — treating the two regimes as alternative rather than concurrent requirements. Both CPCB Type Approval with conformance labelling and BEE label compliance under the 2026 Regulations are independently mandatory at the bill of entry; absence of either triggers detention irrespective of the other being current. Second-hand status must also be disclosed at the time of order placement, not after arrival.
