Of an output exceeding 375 kVA but not exceeding 1,000 kVA
Diesel generating sets, 375 kVA to 1,000 kVA output
HSN 8502 13 10 (diesel generating sets of 375–1,000 kVA output) is subject to Bureau of Energy Efficiency (BEE) appliance labelling and compliance requirements under the Bureau of Energy Efficiency (Appliance Labeling and Compliance) Regulations, 2026, and to Central Pollution Control Board (CPCB) Type Approval and emission/noise norms under Schedule I of the Environment Protection Rules, 1986. Import of second-hand diesel generating sets is Restricted under Para 2.31 of the Foreign Trade Policy, with CBIC customs oversight applying as a concurrent policy overlay.
- Type Approval Certificate from CPCB
- Conformance label from BEE
- Certificate of Conformity of Production from CPCB
Procedural directions for customs clearance are issued by: Central Board of Indirect Taxes and Customs.
- 1Obtain CPCB Type Approval and a Certificate of Conformity of Production, and verify that the generating set carries conformance labelling and meets emission and noise norms for diesel/petrol/kerosene/LPG/NG engines. These requirements apply under Serial Nos. 88, 94, 95, 95A, 95B and 95C of Schedule I of the Environment Protection Rules, 1986, as amended, read with GSR 804(E) dated 03-11-2022.Schedule I (Sr. Nos. 88, 94, 95, 95A, 95B, 95C) of the Environment Protection Rules, 1986 · GSR 804(E) dated 03-11-2022 · CBIC Letter F.No.401/67/2022-Cus III dated 26-05-2023 · CPCB Letter No. CP-29/10/2022-UPC-I-HO-CPCB-HO-927 dated 26-05-2023
- 2Ensure compliance with the Bureau of Energy Efficiency (Appliance Labeling and Compliance) Regulations, 2026, issued vide Notification No. 5506/BEE/S&L/AL/2025-26 dated 26-12-2025, including affixing the prescribed BEE conformance label before the consignment is presented for customs out-of-charge.BEE Notification No. 5506/BEE/S&L/AL/2025-26 dated 26-12-2025
- 3If the consignment comprises second-hand diesel generating sets, note that such imports are Restricted under Para 2.31 of the Foreign Trade Policy and General Note 2 to the Import Policy; a specific import authorisation from DGFT is required before filing the bill of entry.Para 2.31 of the Foreign Trade Policy · General Note 2 to the Import Policy
The most common error on this tariff line is presenting a new generating set with a valid BEE label but without the CPCB Type Approval Certificate and Certificate of Conformity of Production, treating the energy-efficiency clearance as a full substitute for the emission-norms clearance. Both regimes are independent: a consignment lacking CPCB Type Approval is liable to detention and re-export even where BEE labelling is complete. Second-hand units carry an additional Restricted-import status under Para 2.31 of the FTP, which must be resolved before any other clearance is sought.
