Of an output exceeding 75 kVA but not exceeding 375 kVA
Diesel generating sets, 75 kVA to 375 kVA output range
HSN 8502 12 00 (diesel generating sets of 75–375 kVA output) is subject to Central Pollution Control Board (CPCB) Type Approval and emission/noise conformance requirements under Serial Nos. 88, 94, 95, 95A, 95B and 95C of Schedule I of the Environment (Protection) Rules, 1986. Bureau of Energy Efficiency (BEE) appliance-labelling compliance under the Bureau of Energy Efficiency (Appliance Labeling and Compliance) Regulations, 2026 applies concurrently. Import of second-hand diesel generating sets is Restricted under Para 2.31 of the Foreign Trade Policy.
- Type Approval certificate from CPCB
- Certificate of Conformity of Production from CPCB
- BEE conformance label from BEE
Procedural directions for customs clearance are issued by: Central Board of Indirect Taxes and Customs.
- 1Obtain CPCB Type Approval and a Certificate of Conformity of Production for the importing DG set model, confirming compliance with emission and noise norms under Serial Nos. 88, 94, 95, 95A, 95B and 95C of Schedule I of the Environment (Protection) Rules, 1986. Conformance labelling must be affixed to the unit before customs out-of-charge.Schedule I of the Environment (Protection) Rules, 1986 · CBIC Letter F.No.401/67/2022-Cus.III dated 26-05-2023 · CPCB Letter No. CP-29/10/2022-UPC-I-HO-CPCB-HO-927 dated 26-05-2023 · G.S.R. 804(E) dated 03-11-2022
- 2Ensure compliance with the Bureau of Energy Efficiency (Appliance Labeling and Compliance) Regulations, 2026 by affixing the BEE-prescribed energy label to the generating set. Notification No. 5506/BEE/S&L/AL/2025-26 dated 26-12-2025 governs the applicable labelling and compliance requirements.BEE Notification No. 5506/BEE/S&L/AL/2025-26 dated 26-12-2025
- 3If the consignment comprises second-hand diesel generating sets, confirm that import is covered by a valid authorisation under Para 2.31 of the Foreign Trade Policy, read with General Note 2 to the Import Policy — second-hand capital goods in this category carry Restricted status and clearance without prior authorisation attracts confiscation.Para 2.31 of the Foreign Trade Policy · General Note 2 to the Import Policy
The most common error on this tariff line is presenting a CPCB Type Approval certificate for a different engine variant or fuel type than the one actually imported. CPCB conformance certification is model- and fuel-specific — a certificate issued for an LPG variant does not cover a diesel-engine DG set of the same kVA rating, and a mismatch discovered at the port of entry results in consignment detention pending fresh Type Approval, with demurrage and ground rent accruing in the interim.
