HSN 8502 11 00 (generating sets of output not exceeding 75 kVA) is subject to Central Pollution Control Board (CPCB) Type Approval, Certificate of Conformity of Production, and emission/noise-norm compliance under Serial Nos. 88, 94, 95, 95A, 95B and 95C of Schedule I of the Environment (Protection) Rules, 1986. Bureau of Energy Efficiency (BEE) appliance-labelling compliance under the Bureau of Energy Efficiency (Appliance Labeling and Compliance) Regulations, 2026 applies concurrently. Import of second-hand diesel generating sets is Restricted under Para 2.31 of the Foreign Trade Policy.

The most common error on this tariff line is shipping new generating sets with Type Approval in hand but without a valid Certificate of Conformity of Production covering the specific batch — customs officers treat the two documents as independent mandatory requirements, not alternatives. A consignment presenting only Type Approval without batch-level CoCP is detained pending CPCB verification, attracting demurrage and ground rent at the designated port. The BEE labelling obligation under the 2026 Regulations is a separate and concurrent check that cannot be waived by CPCB clearance.
