HSN 8479 89 99 (Other machines and mechanical appliances) is subject to Central Pollution Control Board (CPCB) Extended Producer Responsibility (EPR) authorisation requirements under Schedule I of the E-Waste (Management) Rules, 2022, notified vide G.S.R. 801(E) dated 02-11-2022, for imports of carpet sweepers. The EPR obligation does not apply to micro-enterprises as defined under the Micro, Small and Medium Enterprises Development Act, 2006.
- EPR authorisation from CPCB
- MSME micro-enterprise certificate from MSME Ministry
- 1Verify that a valid Extended Producer Responsibility authorisation has been obtained from the Central Pollution Control Board before filing the bill of entry for carpet sweepers. The EPR authorisation requirement flows from Schedule I of the E-Waste (Management) Rules, 2022, notified vide G.S.R. 801(E) dated 02-11-2022.Schedule I of the E-Waste (Management) Rules, 2022 · G.S.R. 801(E) dated 02-11-2022
- 2If claiming the micro-enterprise exemption from EPR obligations, ensure Udyam registration as a micro-enterprise under the Micro, Small and Medium Enterprises Development Act, 2006 is current and available for verification by the proper officer at the bill-of-entry stage.E-Waste (Management) Rules, 2022 · MSME Development Act, 2006
The EPR authorisation is product-specific and entity-specific: importers who source carpet sweepers from multiple foreign manufacturers must confirm that each manufacturer's products are covered under the registered EPR plan submitted to CPCB. A consignment arriving without a current and product-covering EPR authorisation is liable to detention, and the micro-enterprise exemption is available only where Udyam registration confirming micro-enterprise status is in place at the time of import — post-import registration does not cure the defect.
