The Directorate General of Foreign Trade (DGFT) policy confirms microprocessors under ITC (HS) 8473 30 10 are excluded from the Compulsory HIMS (CHIMS) scheme per DGFT Policy Circular 40/2015-2020. The most common error on this tariff line is assuming the CHIMS exclusion under DGFT Policy Circular 40/2015-2020 also extinguishes the EPR authorisation obligation — it does not. EPR authorisation under the E-Waste (Management) Rules, 2022 is a separate CPCB-administered environmental-compliance requirement that runs concurrently with the DGFT policy position; an importer who holds no CPCB EPR authorisation and is not a qualifying micro-enterprise exposes the consignment to detention and the importer to liability under the Environment (Protection) Act, 1986.
