The most common error on this tariff line is assuming the EPR obligation attaches only to the original equipment manufacturer and not to the importer acting as producer. Under the E-Waste (Management) Rules, 2022, an importer of equipment listed in Schedule I is treated as a producer and must hold its own CPCB EPR authorisation independently of any overseas manufacturer's registration. Consignments cleared without a valid authorisation are liable to detention and may attract prosecution under the Environment (Protection) Act, 1986.
