HSN 8459 51 90 (Other numerically controlled boring and milling machines) is subject to Extended Producer Responsibility (EPR) authorisation administered by the Central Pollution Control Board (CPCB) under the E-Waste (Management) Rules, 2022. The EPR obligation applies to equipment for milling or similar processing of metal and other materials — excluding large-scale stationary industrial tools — as listed under Schedule I of those Rules.
- EPR authorisation from CPCB
- MSME micro-enterprise certificate from MSME
- 1Obtain EPR authorisation from the Central Pollution Control Board before filing the bill of entry. The authorisation is required for import of equipment for milling or similar processing of wood, metal and other materials within the scope of Schedule I of the E-Waste (Management) Rules, 2022 (G.S.R. 801(E) dated 02-11-2022).Schedule I · E-Waste (Management) Rules, 2022 · G.S.R. 801(E) dated 02-11-2022
- 2If the importer qualifies as a micro-enterprise under the Micro, Small and Medium Enterprises Development Act, 2006, document the Udyam registration confirming micro-enterprise status. EPR authorisation does not apply to such enterprises, and the exemption claim must be supported at the bill of entry.E-Waste (Management) Rules, 2022 · MSMED Act, 2006 (micro-enterprise definition)
The scope carve-out for large-scale stationary industrial tools is the most frequently misread element of this entry: importers assume that all industrial CNC milling and boring machines fall outside EPR, when in fact only machines qualifying as large-scale stationary industrial tools are excluded. Equipment that does not meet that threshold remains within Schedule I of the E-Waste (Management) Rules, 2022, and an EPR-less import exposes the consignment to detention and CPCB enforcement action.
