Numerically controlled knee-type milling machines
HSN 8459 31 00 (Numerically controlled knee-type milling machines) is subject to Central Pollution Control Board (CPCB) Extended Producer Responsibility (EPR) authorisation under the E-Waste (Management) Rules, 2022, notified vide G.S.R. 801(E) dated 02-11-2022. The EPR obligation applies to importers of equipment for milling or similar processing of metal and other materials, with the exception of large-scale stationary industrial tools, and is waived only for micro-enterprises as defined under the MSME Development Act, 2006.

The most common error on this tariff line is assuming that all numerically controlled machining centres are 'large-scale stationary industrial tools' and therefore outside EPR scope. The Schedule I exclusion is narrowly construed; unless the machine is explicitly classified as a large-scale stationary industrial tool, CPCB EPR authorisation is required, and importing without it exposes the consignment to detention and CPCB enforcement action independent of customs clearance.
