The EPR-exemption for micro-enterprises is the most common misapplied carve-out on this tariff line: the exemption applies only to importers who hold a valid Udyam registration confirming micro-enterprise status under the MSMED Act, 2006 at the time of import. An importer who crosses the micro-enterprise threshold after registration but before shipment is no longer exempt, and a bill of entry filed without EPR authorisation on that basis will be detained pending CPCB clearance, accruing demurrage and ground rent.
