HSN 8423 30 00 (Constant weight scales and hopper scales) is subject to Legal Metrology registration and product approval under the Legal Metrology Act, 2009 and the Legal Metrology (General) Rules, 2011. Importers of automatic gravimetric filling instruments and discontinuous totalising automatic weighing instruments must hold a valid certificate of registration, which must be uploaded in e-Sanchit before customs out-of-charge.
- Registration certificate from Legal Metrology
- Product approval certificate from Legal Metrology
- Importer weights and measures registration
- 1Obtain Legal Metrology registration and a product approval certificate for automatic gravimetric filling instruments or discontinuous totalising automatic weighing instruments (totalising hopper weights), where applicable. These approvals are governed by Sections 19, 20 and 22 of the Legal Metrology Act, 2009 and Rules 11 to 15 of the Seventh Schedule of the Legal Metrology (General) Rules, 2011 as amended.Sections 19, 20 and 22 of the Legal Metrology Act, 2009; Rules 11–15, Seventh Schedule, Legal Metrology (General) Rules, 2011
- 2Upload the certificate of registration of importer of weights and measures (document code 101lm1) in e-Sanchit before filing the bill of entry. The customs proper officer will verify this document and will not grant out-of-charge until it is present in the system.Legal Metrology Act, 2009; Legal Metrology (General) Rules, 2011; document code 101lm1
The most frequent error on this tariff line is treating Legal Metrology approval as optional on the basis that these instruments are intended for in-plant industrial use rather than trade. Sections 19 and 20 of the Legal Metrology Act, 2009 apply to automatic gravimetric filling instruments regardless of end-use when the instruments are of a class specified in the Seventh Schedule; an unapproved instrument is liable to seizure and the importer faces monetary penalty under the Act.
