Compliance steps
  1. 1
Source only from a Bureau of Indian Standards CM/L-licensed manufacturer holding a current licence against IS 11329:2018 for spiral-type heat exchange units. Verify the supplier's CM/L number, licensed product scope, and manufacturing facility address on the BIS online register before placing the purchase order.

  2. 2
Ensure every unit bears the ISI mark and the supplier's CM/L number, applied per Scheme-I of Schedule-II to the BIS (Conformity Assessment) Regulations, 2018. Marking must appear on the unit itself, not on outer packaging alone.
    Scheme-I of Schedule-II to the BIS (Conformity Assessment) Regulations, 2018 · S.O. 4354(E) dated 05-12-2019
  3. 3
Quote the supplier's BIS CM/L number on the bill of entry. Customs verifies the CM/L in real time against the BIS register; an absent, expired, or product-scope-mismatched licence triggers consignment detention, demurrage, and potential re-export or confiscation.

  4. 4
Check whether the consignment qualifies for an exemption under paragraph 2 of the QCO as amended. Successive amendments — S.O. 1518(E), S.O. 4671(E), S.O. 5095(E), S.O. 5972(E), S.O. 32(E), S.O. 695, and S.O. 1815(E) — have modified the exemption schedule; confirm the version in force on the date of importation.

A word of counsel

The single most common error on this tariff line is assuming that a CM/L licence issued for shell-and-tube or plate heat exchangers under IS 11329:2018 extends automatically to spiral-type configurations. IS 11329:2018 covers multiple heat-exchanger geometries, but the CM/L licence scope is geometry-specific; a supplier licensed for shell-and-tube duty is not licensed for spiral units, and customs will detain a consignment where the declared product type falls outside the licensed scope on the BIS register.

Frequently asked
Does HSN 8419 50 13 require BIS certification?
Yes. Conformity to IS 11329:2018 is mandatory under the ISI Mark Scheme with effect from 01 October 2023; import is permitted only from manufacturers holding a current BIS CM/L licence covering spiral-type heat exchange units at the licensed facility.
Are there exemptions from the BIS QCO for this HSN?
Yes. Paragraph 2 of the QCO as amended by S.O. 1518(E), S.O. 4671(E), S.O. 5095(E), S.O. 5972(E), S.O. 32(E), S.O. 695, and S.O. 1815(E) sets out the current exemption categories; importers must verify the version in force on the date of importation.
Does IS 11329:2018 cover all heat-exchanger types under the same CM/L licence?
No. IS 11329:2018 covers multiple configurations including shell-and-tube, plate, spiral, and brazed-plate designs, but each CM/L licence is scope-specific; a licence issued for one geometry does not authorise import of another geometry.
Is the CM/L licence facility-specific?
Yes. The CM/L licence is tied to the licensed manufacturing facility; units produced at a different plant, even by the same manufacturer, are not covered under the same CM/L number and would trigger detention on a facility-address mismatch at customs.
