The single most common error on this tariff line is overlooking the phased enforcement calendar: importers sourcing from small or micro enterprises — whether foreign or domestic-equivalent — assume the general 07 September 2024 enforcement date applies universally. It does not. Consignments from suppliers that qualify as small enterprises under the MSMED Act, 2006 were outside mandatory ISI Mark scope until 07 December 2024, and micro enterprises until 07 March 2025; demanding a CM/L from a supplier in a deferred category before its effective date, or accepting unmarked goods after it, both produce a mismatch that triggers detention.
