The single most common error on this tariff line is overlooking the staggered enterprise-category enforcement dates. The BIS QCO under S.O. 1801(E) came into force on 26 April 2024 for enterprises other than small and micro, on 19 January 2025 for small enterprises, and on 19 April 2025 for micro enterprises — but a foreign supplier's BIS CM/L obligation is not reduced by the importer's own MSME status. Importers sourcing from unlicensed foreign manufacturers on the assumption that the micro-enterprise deferral applies to them directly face detention and monetary penalty under the BIS Act, 2016.
