HSN 7404 00 21 (empty or discharged brass cartridges) is subject to the ITC (HS) Restricted-import policy administered by the Directorate General of Foreign Trade (DGFT), and clearance is permitted only at specified ports and locations under Para 2.54 of the Handbook of Procedures. A mandatory Pre-Shipment Inspection Certificate (PSIC), generated online through the DGFT portal, and compliance with the Hazardous Waste (Management and Transboundary Movement) Rules, 2016 apply as additional clearance requirements.

    Obtain a Pre-Shipment Inspection Certificate issued by a DGFT-recognised pre-shipment inspection agency (PSIA). The PSIC must be generated online through the DGFT portal with effect from 1 July 2022; PSICs dated on or after 1 July 2022 that were not generated through the DGFT online system will not be accepted by Indian Customs. Upload document code 856001 in e-Sanchit before filing the bill of entry.

    Route the consignment exclusively through specified ports and locations notified under Para 2.54 of the Handbook of Procedures. Ensure compliance with the Hazardous Waste (Management and Transboundary Movement) Rules, 2016 — Rules 11, 12 and 13 — and submit valid Forms 2, 6, 7 and 9 with reference to Schedules III, VI and VIII, as required under Para 8(b) of the General Notes of the ITC (HS) import policy.

    Submit the consignment for random radioactive-contamination checking at the port of import in accordance with the standard operating procedures in the Annexure to DGFT Public Notice 37/2015-20 dated 15-11-2021. Where import originates from a safe country or region and is routed through a specified port, the PSIC requirement may be waived; confirm safe-country status with the DGFT portal before shipment.

A word of counsel

The single most common error on this tariff line is relying on a legacy PSIC not generated through the DGFT online portal. Since 1 July 2022, all PSICs must be generated online via the DGFT website; a PSIC issued on paper by an otherwise recognised PSIA on or after that date is invalid for customs clearance and will result in consignment detention, accumulating demurrage and ground rent, with no rectification pathway short of re-export. Verify PSIA recognition status and PSIC generation method before booking the shipment.
