Compliance steps
  1. 1
Obtain a Pre-Shipment Inspection Certificate from an accredited laboratory of the exporting country, or a valid test report from a Textile Committee or CSRTI laboratory, certifying the absence of prohibited hazardous azo dyes. This document must accompany the bill of entry for all import origins except those listed as exempt.

  2. 2
Verify whether the country of origin qualifies for the azo-dye testing exemption. Imports from EU, Serbia, Poland, Denmark, Australia, Canada, Japan, South Korea and the United Kingdom are exempt from azo-dye testing; all other origins must present the PSIC or test report before out-of-charge.

A word of counsel

The most common error on this tariff line is assuming the country-of-origin exemption applies when the goods are shipped through an exempt country but manufactured elsewhere. The exemption attaches to the country of origin, not the country of export; a consignment of nylon staple fibre manufactured outside the nine exempt countries but transshipped via, say, an EU port remains subject to the full PSIC requirement, and absence of the certificate at the bill-of-entry stage results in detention pending documentary cure.

Frequently asked
Does HSN 5506 10 00 require BIS certification?
No, synthetic staple fibres of nylon or other polyamides are not covered by any BIS Quality Control Order. Import is governed by the ITC (HS) policy administered by the Directorate General of Foreign Trade, with a Pre-Shipment Inspection Certificate requirement under General Note 10 to ensure absence of prohibited hazardous azo dyes.
Which laboratories are authorised to issue the PSIC for azo-dye testing?
The PSIC must be issued by an accredited laboratory of the exporting country; alternatively, a valid test report from the Textile Committee or the Central Sheep and Wool Research Institute (CSRTI) is accepted, per DGFT Public Notice 14/2023 dated 14-06-2023.
What happens if the PSIC is missing at the time of filing the bill of entry?
Absence of the mandatory PSIC or test report results in the consignment being held at the port pending documentary compliance; customs out-of-charge is withheld until the document is produced, attracting demurrage and ground rent for the period of detention.
