HSN 5301 30 00 (Flax tow and waste) is subject to the ITC (HS) Restricted-import policy administered by the Directorate General of Foreign Trade (DGFT), with an additional requirement for Ministry of Environment, Forest and Climate Change (MoEF&CC) permission under the Hazardous Waste (Management and Transboundary Movement) Rules, 2016, as the product is listed under Basel No. B3030. A Pre-Shipment Inspection Certificate certifying absence of prohibited azo dyes is mandated under General Note 10 of the ITC (HS) policy, and imports of Bangladesh origin are restricted to Nhava Sheva seaport only.

- 3If sourcing from Bangladesh, route the consignment exclusively through Nhava Sheva seaport; entry through any land port on the India-Bangladesh border is prohibited. The Basel B3030 classification is the most frequently overlooked compliance layer on this tariff line. Importers who treat flax tow and waste as a straightforward textile input and secure only a DGFT licence without obtaining the separate MoEF&CC permission face confiscation and monetary penalty under the Hazardous Waste Rules, as the absence of MoEF&CC clearance constitutes an independent violation regardless of DGFT licence currency. The Basel Part B listing does not exempt the consignment from prior permission — it merely waives the prior informed consent procedure applicable to Part A hazardous wastes.
