The most common error on this tariff line is assuming that the aviation end-use of the tyres places them outside the hazardous-waste regime. Retreaded and used tyres are classified as hazardous waste by virtue of their condition — not their intended application — and the MEFCC consent obligation applies regardless of whether the importer is an airline, MRO operator, or ground-handling entity. A consignment cleared on the basis of end-use alone, without the MEFCC permission, is liable to confiscation and monetary penalty under the Environment (Protection) Act, 1986.
