Plastic tableware and kitchenware, other than named articles
HSN 3924 10 90 (plastic tableware and kitchenware) is subject to Central Pollution Control Board (CPCB) registration and Extended Producer Responsibility obligations under the Plastic Waste Management (Amendment) Rules, 2022. Single-use plastic articles within this category — including plates, cups, glasses, cutlery, straws, and stirrers — are prohibited from import with effect from 1 July 2022 under Rule 4(2) of the Plastic Waste Management Rules. Directorate General of Foreign Trade (DGFT) policy conditions and Central Board of Indirect Taxes and Customs (CBIC) chemical-qualifier mandates apply as additional clearance requirements.

- 2Verify that no article in the consignment falls within the Single-Use Plastic prohibition under Rule 4(2) of the Plastic Waste Management Rules — specifically plates, cups, glasses, cutlery (forks, spoons, knives), straws, trays, and stirrers are prohibited from manufacture, import, stocking, and sale with effect from 1 July 2022. Carry bags must meet the minimum thickness thresholds: 75 microns from 30 September 2021 and 120 microns from 31 December 2022. The most frequent error on this tariff line is shipping a mixed consignment that includes common food-service items — cups, plates, forks, spoons, or straws — on the assumption that the prohibition applies only to retail sale, not to import. Rule 4(2) of the Plastic Waste Management Rules prohibits the import itself; customs may detain, confiscate, or order re-export of any prohibited SUP article at the port of entry, and the CPCB portal registration for EPR does not cure or exempt a consignment that contains a prohibited article.
