HSN 3921 90 35 (Rigid, laminated plastic plates and sheets) is subject to Central Pollution Control Board (CPCB) Extended Producer Responsibility (EPR) registration under Rule 6 of the Plastic Waste Management (Amendment) Rules, 2022 (G.S.R. 133(E) dated 16-02-2022). The Ministry of Environment, Forest and Climate Change (MoEF&CC) prohibits the manufacture and import of specified single-use plastic commodities with effect from 01-07-2022, and Directorate General of Foreign Trade (DGFT) and Central Board of Indirect Taxes and Customs (CBIC) policy overlays — including mandatory IUPAC and CAS number declarations — apply at the bill of entry.

The most common error on this tariff line is completing CPCB EPR registration as a one-time step and overlooking the ongoing EPR obligation under Rule 7.3, which requires importers to meet annual plastic waste processing targets proportional to import volumes. Failure to fulfil these targets — even when registration is current — constitutes a continuing violation under the Plastic Waste Management Rules and attracts MoEF&CC enforcement action. The IUPAC/CAS declaration is separately verified by CBIC at filing; a missing or incorrect chemical identifier can itself trigger detention independent of EPR status.
