HSN 3920 99 11 (Rigid, plain plastic plates, sheets, film and foil of other plastics) is subject to Central Pollution Control Board (CPCB) Extended Producer Responsibility (EPR) registration under Rule 6 of the Plastic Waste Management (Amendment) Rules, 2022 (G.S.R. 133(E) dated 16-02-2022). The Ministry of Environment, Forest and Climate Change (MoEFCC) prohibits the manufacture and import of specified single-use plastic commodities with effect from 01-07-2022, and CBIC chemical-qualifier declarations under Chapters 28, 29, 32, 38 and 39 apply as a mandatory customs overlay.

The most common error on this tariff line is completing CPCB EPR registration and assuming compliance is achieved, while overlooking that the single-use plastic prohibition under Rule 4(2) is an absolute import ban — not a licensing threshold — for the enumerated commodity sub-types. An importer holding a current EPR registration who imports a prohibited single-use plastic form (for example, wrapping films around invitation cards or PVC banners below 100 microns) faces confiscation and prosecution under the Environment (Protection) Act, 1986 regardless of EPR status. The compostable-plastic carve-out under Rule 4(3) applies only to the commodities listed in Rule 4(2)(b) and requires documentary substantiation at port.
