HSN 3920 69 32 (Flexible, plain polyester film/strip) is subject to Central Pollution Control Board (CPCB) Extended Producer Responsibility (EPR) registration requirements under Rule 6 and Rule 7.3 of the Plastic Waste Management (Amendment) Rules, 2022 (G.S.R. 133(E) dated 16-02-2022). The Ministry of Environment, Forest and Climate Change (MoEFCC) plastic waste prohibition regime and Directorate General of Foreign Trade (DGFT) ITC (HS) policy controls apply as additional clearance requirements. Importers must also declare IUPAC name and CAS number for constituent chemicals at the bill-of-entry stage under CBIC Circular 15/2023-CUS.

The most common error on this tariff line is filing the bill of entry without a live CPCB EPR registration, on the mistaken assumption that the registration can be completed post-arrival. CPCB registration is a pre-import obligation: an unregistered importer has no lawful basis under Rule 6 to bring plastic packaging into India, and the absence of a valid registration number at out-of-charge will trigger consignment detention. The IUPAC/CAS qualifier mandate under CBIC Circular 15/2023-CUS is a separate and concurrent obligation — both must be satisfied before out-of-charge is granted.
