Compliance steps
  1. 1
Register as an importer on the CPCB centralised portal under the Extended Producer Responsibility framework for plastic packaging, as required under Rule 9(1) of Schedule II of the Plastic Waste Management (Amendment) Rules, 2022. The importer category registration must be current before the bill of entry is filed.
GSR 133(E) dated 16-02-2022 · Plastic Waste Management (Amendment) Rules, 2022, Rule 9(1), Schedule II
  2. 2
Ensure compliance with Rules 12 and 13 of the Hazardous Waste (Management and Transboundary Movement) Rules, 2016, and Para 8(b) of the General Notes on Import Policy under ITC (HS) 2022 governing transboundary movement of plastic waste. Additionally, ensure compliance with the Plastic Waste Management (Second Amendment) Rules, 2023.
Hazardous Waste (Management and Transboundary Movement) Rules, 2016, Rules 12 and 13 · GSR 807(E) dated 30-10-2023
  3. 3
Declare the IUPAC name and CAS number of constituent chemicals as mandatory qualifiers at the time of filing the import declaration under Chapter 39. These fields are mandatory for all bills of entry filed on or after 01-10-2023. If the consignment originates from Bangladesh, verify applicability of port restrictions under Para 19 of the General Notes per DGFT Notification 7/2025-26.

A word of counsel

The most frequent compliance failure on this tariff line is obtaining CPCB portal registration but overlooking the concurrent Hazardous Waste Rules overlay: plastic scrap imported without demonstrating compliance with Rules 12 and 13 of the Hazardous Waste (Management and Transboundary Movement) Rules, 2016 is liable to detention and re-export regardless of EPR registration status. The two regimes are independently triggered and must both be satisfied at the bill-of-entry stage.

Frequently asked
Does HSN 3915 90 50 require BIS certification?
No; no BIS Quality Control Order covers plastic waste, parings, or scrap. Import of polyamide waste is governed by the Central Pollution Control Board under the Plastic Waste Management (Amendment) Rules, 2022, and the Hazardous Waste (Management and Transboundary Movement) Rules, 2016, with the ITC (HS) Restricted-import overlay administered by DGFT.
Are the IUPAC name and CAS number declarations mandatory at the time of filing the bill of entry?
Yes. Per CBIC Circular 15/2023-CUS and Circular 18/2023-CUS, declaration of the IUPAC name and CAS number of constituent chemicals is mandatory for all bills of entry under Chapter 39 filed on or after 01-10-2023, in addition to existing declarations.
