Compliance steps
  1. 1
Confirm the foreign manufacturing facility is registered with the Food Safety and Standards Authority of India under the high-risk-food regime for milk and milk products. Upload the FSSAI Import Licence (document code 911001), Specimen Copy of Label (document code 0110FS), and Certificate of Analysis — Food & Supplement (document code 0010FS) in e-Sanchit before filing the bill of entry.
    CBIC Instruction 30/2022-Cus dated 14-11-2022 · FSSAI order dated 10-10-2022 · CBIC Instruction 05/2023-Cus dated 08-02-2023
  2. 2
Upload the Veterinary Health Certificate issued by the exporting country (document code 853AQ1) and the Laboratory Report / Certificate of Analysis (document code 001AQ1) in e-Sanchit, as required for CTIs listed in Annexure A (Sl. No. 1 and Sl. No. 2) of CBIC Circular 24/2022-Cus. These documents are in addition to the FSSAI clearance and must be uploaded before customs out-of-charge.

  3. 3
Route the consignment through one of the 79 designated food-import ports per General Note 4(D) of Schedule I of the ITC (HS) 2022, and verify that the origin is not China — imports of milk and milk-based products from China remain prohibited under DGFT Notification 01/2015-20 dated 23-04-2019 pending melamine-testing capacity upgrades at ports of entry.

A word of counsel

The most frequent error on this tariff line is treating the FSSAI Import Licence as the sole clearance document and overlooking the two AQCS overlays — the Veterinary Health Certificate (853AQ1) and the Laboratory COA (001AQ1) — which are independent of FSSAI's food-safety clearance and are verified separately at the port. A consignment with a current FSSAI licence but missing either AQCS document will be detained pending upload, accruing demurrage and ground rent at the designated port. The China-origin prohibition is absolute and is not waivable by an otherwise valid licence.
