Casein derivatives, caseinates and casein glues (other)
HSN 3501 90 00 (caseinates and other casein derivatives and glues) is subject to Food Safety and Standards Authority of India (FSSAI) Import Licence and labelling compliance under the Food Safety and Standards Act, 2006 and the FSS (Import) Regulations, 2017. Animal Quarantine and Certification Services (AQCS) Veterinary Health Certificate and laboratory certificate clearances apply concurrently, with consignments restricted to food-import entry points under General Note 4(D) of Schedule I of the ITC (HS) 2022.
- Import Licence from FSSAI
- Veterinary Health Certificate from AQCS
- Certificate of Analysis from AQCS
Procedural directions for customs clearance are issued by: Directorate General of Foreign Trade, Central Board of Indirect Taxes and Customs.
- 1Obtain and upload the FSSAI Import Licence (document code 911001), a Certificate of Analysis for food and supplements (document code 0010FS), and a Specimen Copy of Label (document code 0110FS) in e-Sanchit before filing the bill of entry. The Health Certificate (document code 6360AQ) must also be uploaded; customs out-of-charge will not be granted until all four documents are present in e-Sanchit.CBIC Instruction 10/2022-Cus dated 28-06-2022 · Circular 24/2022-Cus dated 28-11-2022 · CBIC Instruction 09/2023-Cus dated 07-03-2023
- 2Upload the Veterinary Health Certificate issued by the exporting country (document code 853AQ1) and the Laboratory Report or Certificate of Analysis (document code 001AQ1) as required for this CTI under Annexure A of Circular 24/2022-Cus. These AQCS documents are separate from the FSSAI food-safety documents and both must be independently current at the time of filing.CBIC Circular 24/2022-Cus dated 28-11-2022 · CBIC Instruction 09/2023-Cus dated 07-03-2023 · FSSAI order dated 18-11-2022 under F.No. Import/TFM/Apex/2022-FSSAI
- 3Route the consignment only through designated food-import entry points per General Note 4(D) of Schedule I of the ITC (HS) 2022. Any labelling deficiencies permissible for rectification under the FSS (Labelling and Display) Regulations, 2020 must be corrected at a customs-bonded warehouse before visual inspection, using a single non-detachable sticker affixed next to the principal display panel without altering the original label.General Note 4(D), Schedule I, ITC (HS) 2022 · FSSAI Letter 1828/Misc Matters/FSSAI/Imports-2021 dated 17-06-2022 · CBIC Instruction 10/2022-Cus dated 28-06-2022
The most common error on this tariff line is treating the FSSAI and AQCS clearances as interchangeable or sequential rather than concurrent and independent. A consignment that carries a current FSSAI Import Licence but is missing either the Veterinary Health Certificate (853AQ1) or the AQCS Laboratory Certificate (001AQ1) will be detained at port regardless of FSSAI status; the two PGA tracks must both be complete before out-of-charge is granted. Rectifiable labelling defects do not cure a missing PGA document, and detention attracts demurrage and ground rent from the day of arrival.
