HSN 2941 10 40 (Cloxacillin and its salts) is subject to Narcotic Drugs and Psychotropic Substances (NDPS) import-certificate requirements under Chapter VII-A of the NDPS Rules, 1985, for imports intended for medical and scientific purposes. The Directorate General of Foreign Trade (DGFT) administers an ITC (HS) Restricted-import policy condition (Policy Condition 2 of Chapter 29) for all other import categories, and Central Board of Indirect Taxes and Customs (CBIC) Circular 23/2023-Cus dated 30-09-2023 mandates additional Chapter 29 qualifiers in the import declaration with effect from 15 October 2023.

The most common error on this tariff line is treating the NDPS import-certificate track and the drug-registration track as mutually exclusive alternatives rather than concurrent obligations: even where the NDPS import certificate under Rule 53 is current, the Drug Registration Certificate (101dc1) and Import Licence for Drugs (9111dc) must independently be uploaded in e-Sanchit, and absence of either triggers detention and ground rent. Importers sourcing from a new foreign facility should confirm that the facility registration is current before booking the consignment, as a registration mismatch at the bill of entry cannot be rectified post-arrival without CDSCO intervention.
