Ergotamine salts and derivatives, other than ergotamine
HSN 2939 62 90 (other derivatives of ergotamine and its salts) is subject to consignment-wise No Objection Certificate requirements administered under the Narcotic Drugs and Psychotropic Substances (NDPS) regime for ergotamine as a controlled substance, per DGFT Notification 15/2015-20 dated 21-07-2015 and the NDPS (Regulation of Controlled Substances) Order, 2013. Items falling within the schedule to the Insecticides Act, 1968 additionally require registration and import permit from the Central Insecticides Board and Registration Committee (CIB&RC), with import restricted to notified places under Rule 45 of the Insecticides Rules, 1971. The most common error on this tariff line is treating the NDPS controlled-substance NOC and the CIB&RC insecticide permit as mutually exclusive — one or the other depending on end-use — when both may be simultaneously required for a single consignment that is scheduled under both regimes. A consignment-wise NDPS NOC is non-transferable and non-reusable; presenting a NOC from a prior shipment at out-of-charge results in detention. Additionally, importers under the PLI Act, 1991 exposure (S.O. 227(E) dated 24-03-1992) must hold a valid insurance policy if the quantity of specified hazardous substance in the consignment exceeds the thresholds notified by the Ministry of Environment and Forests.
