A word of counsel

The most common error on this tariff line is treating the NDPS NOC and the CIB&RC permit as mutually exclusive — importers assume only one regime applies depending on the declared end use. Fenetylline can simultaneously attract NDPS scrutiny as a psychotropic substance and CIB&RC regulation where the substance or a formulation thereof appears in the Schedule to the Insecticides Act, 1968; both clearances must be in hand before the bill of entry, and missing either triggers detention and potential seizure under the respective statute.

Frequently asked
Does HSN 2939 51 00 require BIS certification?
No, fenetylline and its salts are not covered by any BIS Quality Control Order. Import is governed by the Narcotic Drugs and Psychotropic Substances Rules, 1985, requiring a NOC from the Narcotics Commissioner, Gwalior, and, where the substance is scheduled under the Insecticides Act, 1968, registration and permit from CIB&RC under the Insecticides Rules, 1971.
Are there port restrictions on the import of fenetylline under the Insecticides Rules, 1971?
Yes. Where fenetylline or a formulation falls within the Schedule to the Insecticides Act, 1968, import is restricted to ports specified under Rule 45 of the Insecticides Rules, 1971; routing through an unspecified port exposes the consignment to seizure.
Does the Public Liability Insurance requirement apply to every import of fenetylline?
No. The insurance obligation under the Public Liability Insurance Act, 1991, per S.O. 227(E) dated 24-03-1992, is triggered only when the imported quantity of the specified hazardous substance exceeds the thresholds prescribed therein; consignments below those quantities are not subject to the mandatory insurance cover.
