Fenetylline and its salts, psychotropic alkaloid derivatives
HSN 2939 51 00 (Fenetylline and its salts) requires a No Objection Certificate from the Narcotics Commissioner, Gwalior, under the Narcotic Drugs and Psychotropic Substances (NDPS) Rules, 1985, Chapter VII-A, and the ITC (HS) import policy is Free subject to policy condition no. 3 of Chapter 29. Where the substance falls within the Schedule to the Insecticides Act, 1968, registration and import permit from the Central Insecticides Board and Registration Committee (CIB&RC) under Rule 45 of the Insecticides Rules, 1971, apply as a concurrent overlay. Importers must also comply with CBIC Circular 23/2023-Cus dated 30-09-2023 for mandatory Chapter 29 additional qualifiers in the import declaration.

The most common error on this tariff line is treating the NDPS NOC and the CIB&RC permit as mutually exclusive — importers assume only one regime applies depending on the declared end use. Fenetylline can simultaneously attract NDPS scrutiny as a psychotropic substance and CIB&RC regulation where the substance or a formulation thereof appears in the Schedule to the Insecticides Act, 1968; both clearances must be in hand before the bill of entry, and missing either triggers detention and potential seizure under the respective statute.
