Other alkaloids, their salts, ethers, esters and derivatives
HSN 2939 49 00 (other alkaloids and their derivatives) is subject to dual primary regulation: the Central Insecticides Board and Registration Committee (CIB&RC) under the Insecticides Act, 1968 where the substance falls within the scheduled insecticide list, and Narcotic Drugs and Psychotropic Substances (NDPS) controls under Chapter VII-A of the NDPS Rules, 1985 for scheduled narcotic or psychotropic alkaloids. The Directorate General of Foreign Trade (DGFT) ITC (HS) policy condition 2 of Chapter 29 and Central Board of Indirect Taxes and Customs (CBIC) Circular 23/2023-Cus apply as additional clearance requirements.
- Registration certificate from CIB&RC
- Import certificate from NDPS
- Chapter 29 qualifiers from CBIC
Procedural directions for customs clearance are issued by: Directorate General of Foreign Trade, Central Board of Indirect Taxes and Customs.
- 1Where the alkaloid falls within the Schedule to the Insecticides Act, 1968, obtain a registration and import permit from the Secretariat of the Central Insecticides Board and Registration Committee before the bill of entry is filed. Import of scheduled insecticides is restricted to notified places of import under Rule 45 of the Insecticides Rules, 1971.Insecticides Act, 1968 · Rule 45 of the Insecticides Rules, 1971 · ITC (HS) policy condition 2 of Chapter 29
- 2Where the substance is a scheduled narcotic drug or psychotropic substance, obtain an import certificate under Rule 53 of the NDPS Rules, 1985 prior to import. Imports for medical and scientific purposes are governed by Chapter VII-A of the NDPS Rules, 1985; all other imports are governed by Appendix-I to the ITC (HS) Schedule.Chapter VII-A and Rule 53 of the NDPS Rules, 1985 · ITC (HS) policy condition 2 of Chapter 29
- 3Upload mandatory documents in e-Sanchit — certificate of analysis (document code 0010dc), batch release certificate (0030dc), label of consignment (0110dc), registration certificate for drugs (101dc1), and import licence for drugs (9111dc) — and include the mandatory Chapter 29 additional qualifiers in the import declaration per CBIC Circular 23/2023-Cus, with effect from 15 October 2023.CBIC Circular 23/2023-Cus dated 30-09-2023, Para 4.1 and 4.2
The most common error on this tariff line is filing a single-track bill of entry without first establishing whether the specific alkaloid triggers the NDPS regime, the CIB&RC insecticide regime, or both concurrently. Because the product description is a residual 'Other' category, customs officers invariably flag the consignment for PGA verification; missing any one of the five mandatory e-Sanchit documents — particularly the batch release certificate (0030dc) or the import licence for drugs (9111dc) — results in detention and accruing demurrage pending PGA NOC.
