Cinchona alkaloid derivatives other than quinine and quinidine
HSN 2939 20 90 (other cinchona alkaloids and their derivatives) is subject to dual primary-regulator control: Narcotic Drugs and Psychotropic Substances (NDPS) import certificate requirements under Chapter VII-A and Rule 53 of the NDPS Rules, 1985, and Central Insecticides Board and Registration Committee (CIB&RC) registration and import permit under the Insecticides Act, 1968 where the substance falls within its Schedule. Directorate General of Foreign Trade (DGFT) ITC (HS) policy condition 2 of Chapter 29 and Central Board of Indirect Taxes and Customs (CBIC) Circular 23/2023-Cus dated 30-09-2023 apply as mandatory customs overlays.

- 2Where the substance falls within the Schedule to the Insecticides Act, 1968, obtain registration and an import permit from the secretariat of the CIB&RC before import. - 3Ensure all import declarations include the mandatory additional qualifiers for Chapter 29 commodities as stipulated in paragraphs 4.1 and 4.2 of CBIC Circular 23/2023-Cus, with effect from 15 October 2023. The most common error on this tariff line is assuming the NDPS and CIB&RC regimes are mutually exclusive — importers apply only the one they consider applicable and overlook the other. A cinchona alkaloid derivative may simultaneously be a scheduled substance under the Insecticides Act, 1968 and an NDPS-controlled substance; both sets of pre-import clearances are required independently, and the absence of either will result in consignment detention and potential seizure at the port of import.
