The Directorate General of Foreign Trade (DGFT) ITC (HS) policy condition 2 of Chapter 29 governs non-medical imports, and the Central Board of Indirect Taxes and Customs (CBIC) mandates Chapter 29 additional qualifiers in import declarations with effect from 15 October 2023.

- 3Ensure all import declarations include the mandatory additional qualifiers for Chapter 29 commodities as stipulated in para 4.1 and 4.2 of CBIC Circular 23/2023-Cus dated 30-09-2023, applicable with effect from 15 October 2023. Where the consignment involves hazardous substances exceeding specified quantities, obtain an insurance policy under the Public Liability Insurance Act, 1991 per S.O. 227(E) dated 24-03-1992.CBIC Circular 23/2023-Cus dated 30-09-2023 · S.O. 227(E) dated 24-03-1992
The most common error on this tariff line is treating CIB&RC registration as the sole gateway and overlooking the independent NDPS import-certificate requirement, which operates as a parallel obligation. An importer who holds a drug import licence and CIB&RC registration but has not obtained the Rule 53 NDPS import certificate faces consignment detention and potential prosecution under the Narcotic Drugs and Psychotropic Substances Act, 1985 regardless of the status of the other clearances.
