Other opium alkaloids, their salts, esters and derivatives
HSN 2939 19 00 (other alkaloids) is subject to dual primary regulation: substances falling within the Narcotic Drugs and Psychotropic Substances framework require an import certificate under Rule 53 of the NDPS Rules, 1985, while any substance listed in the Schedule to the Insecticides Act, 1968 requires registration and an import permit from the Central Insecticides Board and Registration Committee (CIB&RC) under Rule 45 of the Insecticides Rules, 1971. DGFT ITC (HS) policy condition 2 to Chapter 29 and CBIC Circular 23/2023-Cus apply as additional clearance and declaration requirements.

The most common error on this tariff line is treating the drug-registration documents (101dc1, 9111dc) as the sole clearance pathway and overlooking the parallel NDPS-certificate or CIB&RC-permit obligation when the specific alkaloid is independently scheduled. A consignment that clears the CDSCO drug-import lane but lacks the Rule 53 NDPS import certificate or the CIB&RC permit where one is required is liable to seizure and criminal prosecution under the NDPS Act or the Insecticides Act, 1968, irrespective of the drug-import documents uploaded in e-Sanchit.
