Other polypeptide hormones, derivatives and structural analogues
HSN 2937 29 00 (other polypeptide hormones and structural analogues) is subject to Narcotic Drugs and Psychotropic Substances (NDPS) import-certificate requirements under Chapter VII-A of the NDPS Rules, 1985, for substances falling within the scheduled categories. The Directorate General of Foreign Trade (DGFT) Restricted-import policy condition 2 of Chapter 29 and Central Board of Indirect Taxes and Customs (CBIC) mandatory Chapter 29 qualifier obligations under CBIC Circular 23/2023-Cus apply as additional clearance requirements.
- Import certificate from NDPS
- Registration certificate from CDSCO
- Import licence from CDSCO
Procedural directions for customs clearance are issued by: Directorate General of Foreign Trade, Central Board of Indirect Taxes and Customs.
- 1Where the substance is a scheduled NDPS compound, obtain an import certificate under Rule 53 of the NDPS Rules, 1985 from the Central Bureau of Narcotics before shipment. Imports for medical and scientific purposes are governed by Chapter VII-A of the NDPS Rules, 1985; all other imports are governed by Appendix-I to the ITC (HS) Schedule per ITC (HS) policy condition 2 of Chapter 29.NDPS Rules, 1985 — Rule 53 and Chapter VII-A · ITC (HS) policy condition 2 to Chapter 29
- 2Upload all mandatory drug-related documents in e-Sanchit before filing the bill of entry: Certificate of Analysis — Drug (0010dc), Batch Release Certificate (0030dc), Label of Consignment (0110dc), Registration Certificate (Drugs) (101dc1), and Import Licence for Drugs (9111dc). The proper officer must verify these uploads before granting out-of-charge.CCR e-Sanchit document codes 0010dc, 0030dc, 0110dc, 101dc1, 9111dc
- 3Include mandatory additional qualifiers in the import declaration for Chapter 29 commodities as stipulated in paragraphs 4.1 and 4.2 of CBIC Circular 23/2023-Cus, with effect from 15 October 2023. Note that import of oxytocin is prohibited; import of oxytocin reference standards is allowed exclusively for test and analysis against a test licence issued by DGCI/CDSCO, per S.O. 2357(E) and DGFT Notification 09/2015-2020 dated 23-05-2022.CBIC Circular 23/2023-Cus dated 30-09-2023, paras 4.1 and 4.2 · S.O. 2357(E) · DGFT Notification 09/2015-2020 dated 23-05-2022
The most common error on this tariff line is conflating the NDPS import-certificate pathway with the standard drug-import licence route: the NDPS import certificate under Rule 53 is a separate instrument issued by the Central Bureau of Narcotics, distinct from the CDSCO drug registration and import licence uploaded in e-Sanchit. Filing a bill of entry with only CDSCO documentation — while the substance is also a scheduled NDPS compound — triggers detention and potential confiscation under the NDPS Act, 1985, irrespective of the drug-import licence being current.
