The dual-track regime on this tariff line is the single most common source of detention: importers in the pharmaceutical supply chain assume that a valid drug import licence under the Drugs and Cosmetics Act automatically satisfies the NDPS import-certificate requirement, but the two are independent obligations. An import certificate under Rule 53 of the NDPS Rules, 1985 is a pre-condition for the medical and scientific-use pathway, and its absence — even when all CDSCO drug documents are current and uploaded — constitutes a separate NDPS contravention attracting seizure under the NDPS Act, 1985.
