Sulphafurazole
Sulphafurazole, a sulphonamide antibiotic bulk chemical
HSN 2935 90 12 (Sulphafurazole) is subject to Central Insecticides Board and Registration Committee (CIB&RC) registration and import permit under the Insecticides Act, 1968, where the substance figures in the schedule to that Act, with import restricted to notified places under Rule 45 of the Insecticides Rules, 1971. The Narcotic Drugs and Psychotropic Substances (NDPS) framework applies concurrently where the substance is listed, permitting import for medical and scientific purposes under Chapter VII-A of the NDPS Rules, 1985 after obtaining an import certificate under Rule 53. DGFT ITC (HS) policy condition 2 of Chapter 29 and mandatory Chapter 29 additional qualifiers under CBIC Circular 23/2023-Cus dated 30-09-2023 apply as customs overlays.
- Registration certificate from CIB&RC
- Import permit from CIB&RC
- Import certificate from NDPS
Procedural directions for customs clearance are issued by: Directorate General of Foreign Trade, Central Board of Indirect Taxes and Customs.
- 1If Sulphafurazole appears in the schedule to the Insecticides Act, 1968, obtain registration and an import permit from the Secretariat of the Central Insecticides Board and Registration Committee before shipment. Confirm that the port of import is one of the notified places under Rule 45 of the Insecticides Rules, 1971; import through any non-notified place attracts enforcement under the Insecticides Act, 1968.Insecticides Act, 1968 · Rule 45 of the Insecticides Rules, 1971 · ITC (HS) policy condition 2 of Chapter 29
- 2Where the substance is subject to the NDPS framework, secure an import certificate under Rule 53 of the NDPS Rules, 1985 for medical or scientific purposes under Chapter VII-A of those Rules. Imports outside this category are governed by Appendix-I to the ITC (HS) Schedule. Upload the certificate of analysis (0010dc), batch release certificate (0030dc), label of consignment (0110dc), registration certificate for drugs (101dc1), and import licence for drugs (9111dc) in e-Sanchit before the bill of entry is filed.Chapter VII-A and Rule 53 of the NDPS Rules, 1985 · ITC (HS) policy condition 2 of Chapter 29 · e-Sanchit document codes 0010dc, 0030dc, 0110dc, 101dc1, 9111dc
- 3Ensure the import declaration includes mandatory additional qualifiers for Chapter 29 commodities as stipulated in Para 4.1 and 4.2 of CBIC Circular 23/2023-Cus, applicable with effect from 15 October 2023. Where the consignment exceeds the specified quantities of hazardous substances, the owner must take out an insurance policy under the Public Liability Insurance Act, 1991, per S.O. 227(E) dated 24-03-1992.CBIC Circular 23/2023-Cus dated 30-09-2023 · S.O. 227(E) dated 24-03-1992
The critical error on this tariff line is filing the bill of entry with only the drug-regime documents (registration certificate and import licence for drugs) while omitting CIB&RC registration and permit when the substance is scheduled under the Insecticides Act, 1968. These are independent parallel regimes: drug-clearance documents do not satisfy the pesticide-registration requirement, and the port-restriction under Rule 45 of the Insecticides Rules, 1971 applies regardless of which regulatory track is operative. Consignments arriving at a non-notified port without a CIB&RC permit are liable to detention and seizure even where all NDPS and CBIC documentation is in order.
