Other
Other perfluorooctane sulphonamides, residual organic chemicals
HSN 2935 50 90 (Other perfluorooctane sulphonamides) is subject to Central Insecticides Board and Registration Committee (CIB&RC) registration and import permit under the Insecticides Act, 1968, where the substance figures in the Schedule to that Act. Narcotic Drugs and Psychotropic Substances (NDPS) import-certificate controls under Chapter VII-A of the NDPS Rules, 1985 apply concurrently for any scheduled narcotic or psychotropic substance within this tariff line, with the Directorate General of Foreign Trade (DGFT) ITC (HS) policy condition no. 2 of Chapter 29 governing residual imports.
- Registration certificate from CIB&RC
- Import permit from CIB&RC
- Import certificate from NDPS
Procedural directions for customs clearance are issued by: Directorate General of Foreign Trade, Central Board of Indirect Taxes and Customs.
- 1Determine whether the specific substance being imported figures in the Schedule to the Insecticides Act, 1968. If so, obtain registration and an import permit from the Secretariat of CIB&RC, and route the consignment only through ports permitted under Rule 45 of the Insecticides Rules, 1971. Upload registration certificate (document code 101dc1) and import licence for drugs (document code 9111dc) in e-Sanchit before filing the bill of entry.Insecticides Act, 1968 · Rule 45 of the Insecticides Rules, 1971 · ITC (HS) policy condition 2 of Chapter 29
- 2If the substance is a scheduled narcotic or psychotropic substance, obtain an import certificate under Rule 53 of the NDPS Rules, 1985 (Chapter VII-A) for medical or scientific purposes. Imports outside that category are governed by Appendix-I to the ITC (HS) Schedule and require prior DGFT policy compliance.Rule 53 of the NDPS Rules, 1985 · Chapter VII-A of the NDPS Rules, 1985 · ITC (HS) policy condition 2 of Chapter 29
- 3Ensure the import declaration includes all mandatory additional qualifiers for Chapter 29 commodities as stipulated in paras 4.1 and 4.2 of CBIC Circular 23/2023-Cus dated 30-09-2023, effective 15-10-2023. Where import of specified hazardous substances exceeds the notified threshold quantities, an insurance policy under the Public Liability Insurance Act, 1991 must be in place per S.O. 227(E) dated 24-03-1992.CBIC Circular 23/2023-Cus dated 30-09-2023 · S.O. 227(E) dated 24-03-1992
The most common error on this tariff line is treating CIB&RC and NDPS as mutually exclusive overlays and clearing the consignment under only one regime. A single shipment of perfluorooctane sulphonamide derivatives may simultaneously trigger CIB&RC Schedule-to-the-Act registration, NDPS Rule 53 import-certificate requirements, and the Chapter 29 mandatory-qualifier obligations under CBIC Circular 23/2023-Cus — failure to satisfy any one of these at the bill-of-entry stage results in detention and ground rent pending PGA NOC, with no retrospective cure available once the consignment is flagged.
